Resumo: The present monographic research aims to analyze the State's performance and its mechanisms in the fight against violence in football, demonstrating how its ineffectiveness damages fundamental rights. In order to do so, as far as the level of research was concerned, exploratory research was used since it has the possibility of familiarization with the theme, thus exploring violence in football and its respective punishments. Regarding the qualitative approach, due to the inductive analysis that is done, observing concrete cases and their sanctions to reach the conclusion if such law that regulates this subject is a skilled instrument to solve the problem in question. The procedure used for data collection was the bibliographical, for examining various works, interviews, data and doctrines, seeking information in these media to reach a classification. In the research were analyzed and extracted several data demonstrating the Brazilian reality and the state mechanisms used in the fight against violence in the stages, analyzing its operability aiming at the protection of fundamental rights. In this way, it is concluded that it is up to the State to better apply the current legislation, due to the annual increase in the number of football-related deaths, in order to safeguard the right to safety and leisure of the good supporter.

Para tanto, quanto ao nível de pesquisa, utilizou-se pesquisa exploratória visto ter como possibilidade maior familiarização com o tema, dessa forma explorando a violência no futebol e suas respectivas punições. Com relação a abordagem, qualitativa, devido a análise indutiva que é feita, observando casos concretos e suas sanções para chegar à conclusão se tal lei que regula esse assunto é instrumento hábil para solucionar o problema em questão. O procedimento utilizado para a coleta de dados, foi o bibliográfico, por examinar diversas obras, entrevistas, dados e doutrinas, buscando informações nesses meios para chegar a uma classificação. Na pesquisa foram analisadas e extraídos diversos dados demonstrando a realidade brasileira e os mecanismos estatais utilizados no combate à violência nos estádios, analisando sua operabilidade visando a proteção dos direitos fundamentais.
