Resumo: This work was conducted through a bibliographical research, focusing on the subject the influence of psychoactive substances as a generic circumstance of attenuation of the sentence in the second phase of dosimetry of the criminal sentence. The basic question for the development of the study was: analysis of the possibility of using the generic attenuator provided for in article 66 of the penal code as a form of attenuation of the penalty fixed in the second phase of dosimetry. The general objective of this study was to verify if the psychic state of the agent by the use of psychoactive substances during the delirium practice can be taken as generic attenuation criterion in the calculation of the dosimetry of the sentence, while the specific objectives established were to conceptualize the illicit psychoactive substances, to present the main drugs used in Brazil and its consequences, to relate psychoactive substances and crime, to analyze article 66 of the Criminal Code and to present the possibility of using the thesis on the use of psychoactive substances as hypothesis of attenuation of the sentence at the time of dosimetry. - Article 66 of the Criminal Code (generic mitigation). The present work allowed the understanding that psychoactive substances have been used since the earliest times, and is currently part of the great cause of Brazilian crime, victimizing most of the times not only the user but the whole society. It was observed that the institute studied is little applied by the Brazilian magistrates, but defended by the acting doctrine.

O questionamento base para o desenvolvimento do estudo foi: análise da possibilidade de utilização da atenuante genérica prevista no artigo 66 do código penal como forma de atenuação da pena fixada na segunda fase da dosimetria. O objetivo geral deste foi verificar se estado psíquico do agente pelo uso de substâncias psicoativas durante a prática delitiva pode ser levado como critério de atenuação genérica no cálculo da dosimetria da pena, enquanto os objetivos específicos estabelecidos foram conceituar as substâncias ilícitas psicoativas, apresentar as principais drogas usadas no Brasil e suas consequências, relacionar as substâncias psicoativas e a criminalidade, analisar o artigo 66 do Código Penal e apresentar a possibilidade de utilização da tese de uso de substâncias psicoativas como hipótese de atenuação da pena no momento da dosimetria. - artigo 66 do Código Penal (atenuante genérica). O presente trabalho permitiu a compreensão de que as substâncias psicoativas vêm sendo usada desde os tempos primórdios, e atualmente faz parte da grande causa da criminalidade brasileira, vitimando a maioria das vezes não só o usuária mas sim toda a sociedade.
