Resumo: It is common for public security agents to fear the use of the force permitted to carry out orders or even to use lethal force in situations of armed conflict, since the line that divides legitimate action and excess is tenuous. Aiming at a legal analysis of institutes that support public security agents and law it was sought through the doctrinal and jurisprudential understandings to verify if there is legal certainty in the police action in this authentic urban witch that occurs in several regions of the country. Through doctrinal research and jurisprudence, it was verified weaknesses in the substantive and procedural criminal law that may lead to complaints, unjust pronouncements and convictions based on the moral value of those who judge. Legal insecurity is only one of the many problems encountered by public security agents in the exercise of police activity. The omission of the State to provide the structure and legal certainty necessary for the agents who are the front line of society against crime will still be responsible for many unnecessary deaths.

Visando uma análise legal dos institutos que amparam os agentes de segurança pública e a aplicação da lei se buscou por meio dos entendimentos doutrinários e jurisprudenciais verificar se há segurança jurídica na atuação policial nesta autêntica guerra urbana que ocorre em diversas regiões do país. Por meio de pesquisas doutrinárias e jurisprudências, verificaram-se fragilidades no direito material e processual penal que podem ensejar denúncias, pronúncias e condenações injustas fundadas no valor moral de quem julga. A insegurança jurídica é só um dos diversos problemas encontrados pelos agentes de segurança pública no exercício da atividade policial.
