OBJECTIVE: To analyze the kind of civil liability applied to the parents for the acts of underage children, especially in the event of a traffic accident caused by them. METHOD: Regarding the depth of the research, this will be exploratory, and the approach will be qualitative. The data collection procedure will be the bibliographic, which will be done mainly through doctrines and master's and post-graduate dissertations. RESULTS: It was verified that the kind of civil liability applied to the parents for the acts of the underage children is the objective, that is, in which the culprit or the deceit of the agent causing the damage is not affected, it being sufficient to prove the causal link between their conduct and the harm done to the victim. CONCLUSION: It is concluded that the parents responsibility for the traffic accident caused by the underage children is objective, and if there is damage to the third, the duty for both parents to indemnify him / her will be born, regardless of which parent has custody of the infant, since our Federal Constitution states that it is the duty of parents to raise and educate their children in order to achieve their full development, preparing them for life in society. It is not fair to confer upon the wrong father, who no longer answers for the acts of his children.
