This monographic study had the main objective to analyze the possibility of compensation for moral damages in cases of adopted "returning" during the stage of accommodation. To achieve this goal we used the deductive method of approach; regarding the procedure method we used the literature, since, made use of doctrines, scientific articles, laws and jurisprudence related to the proposed theme. Research has beginning with the study of liability by giving more emphasis in regard to moral damage. Subsequently, the study entered under the family law to then analyze the adoption institution in the Brazilian legal system. Finally, we studied the possibility of "returned" adopted in the accommodation period being repaired for damages, according to the understanding of doctrine and jurisprudence. Whereas the stage of coexistence it is a right of the child and adolescent, and not the foster parents alleged, and as this period produces on the adopted expectation / hope that their adoption will be definitive. Also that the "return" directly affects their right of personality, it is concluded that, verified the reasons which led to the adoption withdrawal in each case, it’s possible a compensation for moral damage in cases with adopted returning during accommodation stage.
