The present job looked to analise the applicability of Sucession Rights rules, related to exclusively digital patrimony. It began talking about Sucession Rights in the land legal order, highlighting it’s historic evolution and weaving considerations about the sucession opening, order of hereditary vocation and sucession species. On the sequence, spoked up about Virtual Rights in Brazil, highlighting the principles and rights relevant to the theme, like humans person dignity, expression liberty, intimity, privacity and information, such as existing brazilian legislation about Virtual Rights. Got into digital heritage theme, making considerations about the theme in Brazil, and in some forager ordinaments, beyond talking about communication tecnology and social media, still focusing on the personality and privacity rights of the heritage author. It was observed the existance of Law Projects that talk about digital heritage, pre-existing mechanism and some concret cases where the subject matter were discussed. The research shows up relevant because of the many tecnology innovations that are happening in a each time faster way, even because the virtual world changed the living way of the majority of the people, showing up inquiries about virtual patrimony destination, after it’s owner death.
