The present study intent to elucidate the main causes for the appearance of false memories, and the incidence of this phenomenon in the criminal law, which justifies the fallibility of the reports in the oral evidence. The line of research adopted is Justice and Society, with the main objective of identifying whether oral evidence in criminal proceedings can contaminate the sentences due to the existence of false memories of the people heard. The importance of the work relies in the understanding of the phenomenon of false memories, analyzing the influences exerted in the realization of people recognition and reporting the facts, identifying the consequences generated in convincing the magistrate. The method of approach to thinking is deductive, and qualitative research with monographic procedure and bibliographic technique. Demonstrating that memories are susceptible to influence, resulting in effects that alter information in the production of oral evidence in criminal proceedings.
