This study aimed to analyse unruly passenger fact as how it is established in aviation culture and daily life in Brazil, its prediction and sanction in normative and legal texts (specifically in the Airlines Transport Agreement), considering the phenomenon constitutes serious violation of the safety and comfort of all passengers and flight crew on a commercial flight. The research was exploratory, with qualitative approach to the research problem. A survey of bibliography was performed in papers, research results, as well as in legal and normative documents. The methodological procedures are both bibliographic and documentary. Special attention was given to the fact that research is still incipient in the area, which required notions and overview from various areas. The developed research allows us to say that unruly passenger is still a challenging issue for everyday life, logistics, economy, development of the culture of flying and air transport. Expectations are expressed in legislation and throughout the regulatory framework as to what is expected of the passenger, but not yet corresponding to the weight of the unruly passenger at national aviation context. So, we can say that there is a gap in the legislation and normative procedures or regulatory instruments so that there is greater force that demarcates the place of discipline as a way to flight success and responsibility of the passenger.
