Resumo: The purpose of this article is to discuss and criticize the Resolution 487 of the National Council of Justice, which intends to extinguish forensic psychiatric hospitals in Brazil. The resolution violates Law 10.216, when it does not guarantee that people with mental disorders will have access to the best treatment in the health system, in accordance with their needs. Consequently, it harms society, patients with mental disorders and health services, imposing risk to them.

La resolución viola la Ley 10.216, al no garantizar que las personas con trastornos mentales tengan acceso al mejor tratamiento en el sistema de salud, acorde a sus necesidades. En consecuencia, perjudica a la sociedad, a los pacientes con trastornos mentales y a los servicios de salud, imponiéndoles un riesgo.O objetivo do presente artigo é discutir e realizar críticas em relação à Resolução 487 do Conselho Nacional de Justiça, que pretende extinguir os Hospitais de Custódia e Tratamento Psiquiátrico no Brasil. A resolução fere a Lei 10.216, quando não garante ao padecente de transtorno mental, ter acesso ao melhor tratamento do sistema de saúde, consentâneo às suas necessidades.
