Resumo: The common sense that copyright provides adequate protection for designs is questioned in this work, whose objective is to establish a comparison between this protection and industrial design in order to determine the most appropriate option for design projects. The deductive method was used with bibliographic and documentary research techniques. The discussion contemplates the role of design as a tool of differentiation and value addition that increases competitiveness, interfering directly in the performance of companies. The results show that copyright protection can be useful in the context of artistic and craft production, but in the context of a standardized and staged industrial production, the appropriate protection is the registration of industrial design. The results also highlight the need to insert the theme of industrial design protection from design schools.

The results also highlight the need to insert the theme of industrial design protection from design schools.En este trabajo se cuestiona el sentido común de que el derecho de autor brinda una protección adecuada a los diseños, cuyo objetivo es establecer una comparación entre esta protección y la del diseño industrial para determinar la opción más adecuada para los proyectos de diseño. Se utilizó el método deductivo con técnicas de investigación bibliográfica y documental. La discusión contempla el rol del diseño como herramienta de diferenciación y agregación de valor que incrementa la competitividad, interfiriendo directamente en el desempeño de las empresas. Los resultados muestran que la protección de los derechos de autor puede ser útil en el contexto de una producción artística y artesanal, pero en el contexto de una producción industrial, estandarizada y escalonada, la protección adecuada es el registro de un diseño industrial. Los resultados también muestran la necesidad de incluir el tema de la protección por el diseño industrial desde las escuelas de diseño.O senso comum de que os direitos autorais fornecem proteção adequada para os designs é questionado neste trabalho, cujo objetivo é estabelecer uma comparação entre esta proteção e a de desenho industrial a fim de determinar a opção mais adequada para projetos de design. Foi utilizado o método dedutivo com técnicas de pesquisa bibliográfica e documental. A discussão contempla o papel do design enquanto ferramenta de diferenciação e agregação de valor que incrementa a competitividade, interferindo diretamente na performance das empresas. Os resultados evidenciam que a proteção por direitos autorais pode ser útil no âmbito de uma produção artística e artesanal, mas, no contexto de uma produção industrial, padronizada e escalonada, a proteção adequada é o registro de desenho industrial.
