The gestaltical matrix in the analysis of the novelty and originality requirements of the industrial design: a case study of the cabinets´ case judged by the Federal Regional Court of the 2nd Region

Resumo: Industrial design is a type of intellectual property that grants exclusive market rights over designs. Its analysis and possible grant are made by the Brazilian Patent and Trademark Office, which is responsible for verifying compliance with the requirements established by Law No. 9,279/96. When, however, there is non-compliance with the decisions of the federal autarchy, the cases are taken to the Judiciary. The objective of this study is to make a critical analysis of the decision rendered by the Federal Regional Court of the 2nd Region in the trial of the cancellation of the industrial design registration BR 30 2013 006726-2 in the light of the Gestalt theory applied to the examination of the novelty and originality requirements. As results, it is pointed out evidences of the mismatch of the judicial decision. Moreover, it is proposed the adoption of the Gestalt methodology in the examination of similar issues.
