INCLUSIVE EDUCATION FOR UNLEASHING THE TALENTS OF PERSONS WITH DISABILITIES

Resumo: Recurrently, many Brazilians are born or become, through some fatality, people with disabilities. This requires the development of strategies and actions to ensure their equal rights. In this direction, the research aimed to identify and analyze the legal aspects of Law No. 13.146/2015, in relation to education, and reflect on its effectiveness from recent research on the subject. For the data analysis, the content analysis was chosen. The results showed that there is still a lot of work to be done in order to realize the rights expressed in the legislation, such as the development and implementation of public policies that welcome people with disabilities in their entirety. We emphasize that legislation is an essential step for the educational inclusion of people with disabilities, but many other barriers need to be broken down, including prejudice.

En esta dirección, la investigación tuvo como objetivo identificar y analizar los aspectos legales de la ley nº 13.146/2015 en lo que respecta a la educación y, a partir de investigaciones recientes sobre el tema, reflexionar sobre cómo llevarlos a cabo. Para el análisis de los datos, se optó por el análisis de contenido. Los resultados señalaron que aún hay mucho por hacer para que los derechos expresados en la legislación se logren, como la elaboración y ejecución de políticas públicas que incluyan a la persona con discapacidad en su totalidad. Destacamos que la legislación es una etapa esencial para la inclusión educativa de las PcD, pero muchas otras barreras deben ser superadas, entre ellas, el prejuicio.Recorrentemente, muitos brasileiros nascem ou tornam-se, por alguma fatalidade, uma pessoa com deficiência (PcD), requerendo a elaboração de estratégias e ações que lhes garantam a igualdade de direitos. Nessa direção, a pesquisa visou identificar e analisar os aspectos legais da lei nº 13.146/2015, no que concerne à educação e, a partir de pesquisas recentes sobre o tema, refletir como efetivá-los. Para análise dos dados optou-se pela análise de conteúdo. Os resultados apontaram que ainda há muito a ser feito para que os direitos expressos na legislação sejam alcançados, como a elaboração e execução de políticas públicas que acolham a pessoa com deficiência em sua totalidade.
