Multiparentality: successive effects of the concomitance between socio-affective kinship relationship and biological recognition

Resumo: | Kinship is no longer confined to the field of inbreeding given its inability to define relationships established between individuals. Biological determinism, in itself considered, generates a reductionist and unfinished vision of kinship, not adding in its framework, the potentiality of affection. The article aims to discuss the succession effects arising from the concomitance between socio-affective kinship and biological recognition within the multiparental family. It will be a descriptive-exploratory research, with a qualitative approach, developed through bibliographical technique and documentary analysis. Multiparentality is a familiar format that allows for the coexistence of the biological and affective aspects of parenthood, thus generating repercussions on the succession that challenge the civilian legislator, as well as the delimitation of the legal effects that ensue. In this way, in the judgments of the courts, the courts proceed more and more to the recognition of affection, in order to establish the appropriate succession treatment. In view of this, it is intended to highlight the concrete difficulties born due to affective kinship, regarding the transfer of assets. In order to eliminate situations of disproportionality and attack on the dignity of the human person in the inheritance of goods of the de cujus in favor of ascendants, the maternal and paternal lines should be ignored when interpreting the norm, which should be applied based on the principle of equality between the heirs in the same degree. |

El determinismo biológico, por sí solo considerado, genera visión reduccionista e inacabada del parentesco, no agregando en su estructura, la potencialidad del afecto. El artículo tiene por objeto discurrir acerca de los efectos sucesorios resultantes de la concomitancia entre el parentesco socioafectivo y el reconocimiento biológico en el ámbito de la familia multiparental. Se tratará de una investigación descriptiva-exploratoria, de abordaje cualitativo, desarrollada por medio de la técnica bibliográfica y de análisis documental. La multiparentalidad constituye un formato familiar que posibilita la coexistencia de los aspectos biológicos y afectivos de la parentalidad, generando así, repercusiones en el ámbito sucesorio que desafían al legislador civilista, así como la delimitación de los efectos jurídicos que se derivan. De este modo, en los juzgados patrios, los tribunales proceden cada vez más al reconocimiento del afecto, a fin de establecer el tratamiento sucesorio adecuado. En ese dibujo, se pretende evidenciar las dificultades concretas nacidas en razón de la desbiologización del parentesco, en lo que se refiere a la transmisión patrimonial. Para eliminar las situaciones de desproporcionalidad y de ataque a la dignidad de la persona humana en la herencia de bienes del de cujus a favor de los ascendientes, las líneas maternas y paternas deben ser ignoradas cuando la interpretación de la norma, que debe aplicarse pautada en el principio de igualdad entre los herederos en el mismo grado.O parentesco já não se restringe ao campo da consanguinidade dada a inaptidão desta para definir as relações estabelecidas entre indivíduos. O determinismo biológico, por si só considerado, gera visão reducionista e inacabada do parentesco, não agregando em seu arcabouço, a potencialidade da afeição. O artigo tem por objetivo discorrer acerca dos efeitos sucessórios decorrentes da concomitância entre o parentesco socioafetivo e o reconhecimento biológico no âmbito da família multiparental. Tratar-se-á de uma pesquisa descritiva-exploratória, de abordagem qualitativa, desenvolvida por meio da técnica bibliográfica e de análise documental. A multiparentalidade constitui formatação familiar que possibilita a coexistência dos aspectos biológicos e afetivos da parentalidade, gerando assim, repercussões no âmbito sucessório que desafiam o legislador civilista, bem como a delimitação dos efeitos jurídicos daí advindos. Deste modo, nos julgados pátrios, os tribunais procedem cada vez mais ao reconhecimento do afeto, a fim de estabelecer o tratamento sucessório cabível. Nesse desenho, evidencia-se as dificuldades concretas nascidas em razão da desbiologização do parentesco, no que tange à transmissão patrimonial. Não somente isto, aponta-se a necessidade de resolução das problemáticas sucessórias advindas deste fenômeno de concomitância parental, vez que o Código Civil vigente é omisso quanto ao tema.
