No. of bitstreams: 1 50001995.pdf: 362664 bytes, checksum: 57cd79cceda10298516225e5daff0fac (MD5) Previous issue date: 2005Monograph that investigated the principle of the social purpose of the procedural law of the work, in Brazil, by means of which if it aimed at to the proposal of a reflection on the Brazilian law culture, in the direction to point the necessity of if questioning the dogma of the working procedural norms, with authorization of the instrumentally character of the action at law. Still, it objectified to desvelar the potentiality of such principle for the conduction joust of the process of solution of the decurrent conflicts of the relation of the human work. The intuition method allowed that the researcher did not contaminate itself previously with the lawculture influences until then predominant in Brazil and, thus, had the guarantee of if reaching the waited results. The modern instrumentally specter of the action at law, in attendance to the constitutional postulate of substantial due process of law, ally to the tout of appeals law principles to the proper normative power of the basic laws (Constitution), if duly used or applied for the agencies judiciary, this in foot of equality with the too much powers of the Republic, propitiates the valuation of the human work that, for consequence, minimizes in ratio jousts the social inaqualities. The principle of the social purpose, as procedural norm, imposes that the solution of the labor conflict if gives exactly with social justice that has written law making use of inapt form to reach this end.
