PUBLIC CONSULTATIONS AS A MECHANISM FOR LEGITIMIZING NORMATIVE ADMINISTRATIVE ACTS

Resumo: | Objective: This paper is dedicated to the survey and analysis of the regulations of public consultations in Brazil and other Latin countries, formulating proposals to enable the democratic effectiveness of the institute in the administrative processes of creation of normative acts, encouraged by Law no. 13,655 (BRASIL, 2018), which amended the LINDB.Methodology: The empirical research employs documentary analysis of the legislation of Latin American countries with a socioeconomic reality close to that of Brazil to collect elements that enable the formulation of proposals for the effective application of the institute in Brazil. For this, eleven Latin countries were selected, whose legislations were consulted electronically by accessing the federal government sites, verifying the norms pointed out by the entities as regulating the public consultations. The theoretical framework was based on Jürgen Habermas's theory of proceduralist deliberative democracy, Hannah Arendt's concept of politics, and the constitutionalization of Administrative Law.Results: It was verified that there is an unsatisfactory regulation of the institute of public consultations in Brazil and in most of the researched countries, besides deducing that, thus, the institute has been used in a way to integrate only the legitimation rhetoric of the Public Administration, without properly fulfilling its democratic purpose.Contributions: The article contributes to the improvement of the regulation of public consultations in Brazil so that it actually meets its democratic assumptions and legitimizes normative administrative acts. Thus, based on the theoretical framework and the data collected, elements are proposed that should be observed when regulating and applying the institute. |

Metodología: La investigación empírica emplea el análisis documental de la legislación de países latinoamericanos con una realidad socioeconómica cercana a la de Brasil para recoger elementos que permitan la formulación de propuestas para la aplicación efectiva del instituto en Brasil. Para ello, se seleccionaron once países latinos, cuyas legislaciones fueron consultadas por vía electrónica con el acceso a los sitios del gobierno federal, verificando las normas señaladas por las entidades como reguladoras de las consultas públicas. Como marco teórico, se busca amparo en la teoría de la democracia deliberativa procedimentalista de Jürgen Habermas, en la Concepción de la política de Hannah Arendt y en la constitucionalización del Derecho Administrativo.Resultados: Se verificó que existe una regulación insatisfactoria del instituto de las consultas públicas en Brasil y en la mayoría de los países investigados, además de deducir que, así, el instituto ha sido utilizado de manera de integrar solamente la retórica de legitimación de la Administración Pública, sin cumplir adecuadamente su finalidad democrática.Contribuciones: El artículo contribuye al perfeccionamiento de la regulación de las consultas públicas en Brasil para que realmente cumpla con sus supuestos democráticos y legitime los actos administrativos normativos. Así, a partir del marco teórico y de los datos recogidos, se proponen elementos que deben observarse a la hora de regular y aplicar el instituto.Objetivo: O trabalho se dedica ao levantamento e à análise das regulamentações de consultas públicas do Brasil e de outros países latinos, formulando propostas para viabilizar a eficácia democrática do instituto nos processos administrativos de criação de atos normativos, incentivado pela Lei nº 13.655 (BRASIL, 2018), que alterou a LINDB.Metodologia: A pesquisa empírica emprega a análise documental das legislações de países da América Latina com realidade socioeconômica próxima à brasileira para coletar elementos que viabilizem a formulação de propostas para a aplicação eficaz do instituto no Brasil. Para tanto, foram selecionados onze países latinos, cujas legislações foram consultadas pela via eletrônica com o acesso aos sites governamentais federais, verificando as normas apontadas pelos entes como regulatórias das consultas públicas. Como marco teórico, buscou-se amparo na teoria da democracia deliberativa procedimentalista de Jürgen Habermas, na concepção de política de Hannah Arendt e na constitucionalização do Direito Administrativo.Resultados: Verificou-se que há uma regulamentação insatisfatória do instituto das consultas públicas no Brasil e na maioria dos países pesquisados, além de se deduzir que, assim, o instituto tem sido usado de forma a integrar apenas a retórica de legitimação da Administração Pública, sem cumprir propriamente sua finalidade democrática.Contribuições: O artigo contribui para o aprimoramento da regulamentação das consultas públicas prévias a atos administrativos normativos, no Brasil, para que elas, de fato, atendam aos seus pressupostos democráticos e legitimem o agir abstrato do Estado.
