HYPERVULNERABILITY OF THE ELDERLY CONSUMER IN FRONT OF OVER-INDEBTEDNESS

Resumo: Context: In contemporary times, what can be called mass society has developed, which is marked, mainly, by the excessive consumption of material goods and by various abuses in the face of vulnerable subjects, such as the elderly. In order to protect such individuals, brazilian law number 14.181/2021 emerges, which seeks to establish the recognition of the hypervulnerable condition of the elderly and the duty to safeguard their rights in the face of over-indebtedness. Objective: Investigate the implications provided by brazilian law number 14.181/2021, especially in the sense of investigating the contours of the hypervulnerability of the elderly and their propensity to excessive indebtedness, without, however, ignoring the innovations provided by the principle of responsible credit, combating consumer harassment, as well as the institute of debt renegotiation of over-indebted consumers. Methodology: The present study was conducted through the selection of specialized bibliography, as well as recent brazilian jurisprudential understandings and decisions issued by the National Council for Advertising Self-Regulation, using the deductive method. Conclusion: The precepts dealt with by brazilian law number 14.181/2021, in addition to creating and reinforcing the individual rights and guarantees of the elderly duly recognized by the legal system, also establish new perspectives on the treatment of excessive indebtedness of the elderly as hypervulnerable consumers.

Para proteger a dichas personas se creó la Ley n° 14.181/2021, busca establecer el reconocimiento de la condición hipervulnerable de las personas mayores y el deber de salvaguardar sus derechos frente al sobreendeudamiento. Objetivo: Investigar las implicaciones previstas por la Ley nº 14.181/2021, especialmente con el fin de explorar los contornos de la hipervulnerabilidad de las personas mayores y su propensión al endeudamiento excesivo, sin embargo, las innovaciones aportadas por el principio de crédito responsable, lucha contra el acoso a los consumidores, así como el instituto para la renegociación de deudas de consumidores sobreendeudados. Metodología: El presente estudio se realizó a través de la selección de bibliografía especializada, así como de precedentes jurisprudenciales e decisiones dictadas por el Consejo Nacional de Autorregulación Publicitaria, utilizándose para tal efecto el método deductivo. Conclusión: los preceptos abordados por la Ley nº 14.181/2021, además de crear y reforzar los derechos y garantías individuales de ancianos debidamente reconocidas por el Ordenamiento Jurídico, también establecen nuevas perspectivas sobre el tratamiento del endeudamiento excesivo de las personas mayores como consumidores hipervulnerables.Contextualização: Na contemporaneidade, desenvolveu-se aquilo que pode ser denominado de sociedade de massa, que é marcada, principalmente, pelo consumo excessivo de bens materiais e por diversos abusos em face de sujeitos vulneráveis, como é o caso dos idosos. No sentido de proteger tais indivíduos, surge a Lei nº 14.181/2021, a qual busca estabelecer o reconhecimento da condição hipervulnerável da pessoa idosa e do dever de salvaguarda de seus direitos defronte ao superendividamento. Objetivo: Investigar as implicações proporcionadas pela Lei nº 14.181/2021, especialmente no sentido de perquirir os contornos da hipervulnerabilidade do idoso e sua propensão ao endividamento excessivo, sem, contudo, ignorar as inovações proporcionadas pelo princípio do crédito responsável, o combate ao assédio de consumo, bem como o instituto da repactuação de dívidas do consumidor superendividado. Metodologia: O presente estudo foi conduzido por meio da seleção de bibliografia especializada, bem como de entendimentos jurisprudenciais recentes e decisões proferidas pelo Conselho Nacional de Autorregulamentação Publicitária, utilizando-se, para isso, do método dedutivo.
