Resumo: This paper analyzes the three pillars of social security and their respective characteristics for demonstrate the persistent miss understanding of them. Although the Federal Constitution is more than 25 years old, the courts still justify the granting or the denial of "benefits" based on wrong requirements. Supported by extensive bibliography and using the inductive method, this article aims to dispel the conflicting interpretation and to promote respect for the Constitution

Embora a Constituição Federal já tenha mais de 25 anos de promulgação, observa-se que os Tribunais ainda justificam a concessão ou a denegação de “benefícios” com base em requisitos equivocados.
