Resumo: This article analyzes the constitucional mutation made by the Brazilian Supreme Court at the judgment of the HC. 126.292/SP, in a specifically relation to the the presumption of innocence (article 5, item LVII of 1988 Federal Constitution). The article pretends to construct the conclusion that the Supreme Court cannot usurp the attributions of the Originary Constituent Power, mainly when this means a retrocession of Rights and Fundamental Guarantees, whatever the reason.
