Resumo: The Brazilian Supreme Court quite often alters the substantive and temporal scopes of judicial review decisions (effects modulation decisions). This paper performs an analysis of two decisions altered by the Court through the lens of Luhmanns systems theory, in order to reflect on art. 27 of Law nº 9.868/99 proper reading and effects modulation decisions trend to rest on grounds unrelated to the main constitutional issue. This broadens the decision possibilities and undermines the legal system autonomy, but departs from luhmannian doctrines.
