Elements of Theory of Legal Interpretation and its Application to Last Wills and Testaments

Resumo: The succession "causa mortis" is the change in ownership of legal relations, operated by reason of a person's death. A person may be called to succeed other because of the law or because of a will left by the deceased. The will is a legal transaction in which a person expresses his last will. This will must be interpreted in order to comply as much as possible what we really wanted the author. On the other hand, one of the General Theory of Law objects of study is the Theory of Legal Interpretation. In general, it is understood that the interpretative activity is the search for meaning and scope of the terms present in the positive law. This study seeks to understand how the Interpretation Theory can help testamentary hermeneutics, aiming at the best way to achieve the true wishes of the last will.

Determinado sujeito de direito pode ser chamado a suceder outrem em razão da lei ou de um testamento deixado pelo falecido. O testamento é negócio jurídico em que a pessoa manifesta a sua última vontade. Esta vontade deve ser interpretada de forma a respeitar o máximo possível aquilo que realmente desejou o testador. Por outro lado, um dos objetos de estudo da Teoria Geral do Direito é a Teoria da Interpretação Jurídica. De modo geral, entende-se que a atividade interpretativa é a busca pelo sentido e alcance das expressões presentes no direito positivo.
