People with Disabilities and the Effectiveness of Labor Rights in Brazil: Public Policy and Equality

Resumo: The purpose of this article is to analyze the Brazilian labor market from the perspective of people with disabilities, in order to achieve labor rights, providing a fair labor activity, dignified and equal to such people. The tour methodological approach, based on literature and statistical data. Despite advances, there are still many barriers to be overcome by persons with disabilities for their integration into the labor market on equal terms. The Quota Law is the main reason for recruitment of one of them. In that sense, it seeks to affirm the importance of ILO Conventions and Recommendations in promoting equality and integration of people with disabilities in the labor market. It is noteworthy, too, before the Brazilian reality the need for public policy in promoting the exercise of work activity on equal opportunities and attentive to the real aspirations of people with disabilities. Lastly, there is the role of Quota Law (Law 8,213 / 91) and the advances brought by the Brazilian Law of Inclusion (Law 13,146 / 2015) the consolidation of a fair and equitable labor market for people with disabilities. It is concluded that public policy awareness and acceptance of people with disabilities in the light of human dignity, taking for granted the union's executive, legislative, judiciary and the whole society to develop such policies, prove to be important instruments in the sense of providing equal opportunity and treatment, inclusion, non-discrimination and the welfare of such workers who are in a vulnerable context.

O caminho metodológico percorrido baseia-se em pesquisa bibliográfica e em dados estatísticos. Apesar dos avanços, ainda há muitas barreiras a serem vencidas pelas pessoas com deficiência para sua integração ao mercado de trabalho em igualdade de condições. A Lei de Cotas ser o principal motivo de contratação é um deles. Nesse sentido, busca-se afirmar a importância das Convenções e Recomendações da OIT na promoção da igualdade e integração das pessoas com deficiência no mercado de trabalho. Ressalta-se, também, diante da realidade brasileira a necessidade de políticas públicas no fomento do exercício da atividade laborativa em igualdade de oportunidades e atento aos reais anseios da pessoa com deficiência. Por fim, destaca-se o papel da Lei de Cotas (Lei 8.213/91) e os avanços trazidos pela Lei Brasileira de Inclusão (Lei 13.146/2015) na consolidação de um mercado de trabalho justo e equitativo para as pessoas com deficiência.
