Resumo: This article reflects critically on the legislative reforms being discussed in the Brazilian Congress that threatens formal equality among workers, with side effects that will impact the integrity of the employment relationship. This reflection is based on the view that Labor Law was consolidated on two fundamental principles: non-discrimination and employment protection. These are two principles that underpin the system of guarantees which are inherent in a relationship of subordinate employment, based on social justice and valuation of human work as instruments of economic development in order to ensure an adequate level of juridical safety that links to social well-being.

O texto parte da concepção de que o Direito do Trabalho se consolidou em função de dois princípios fundamentais: a não discriminação e a proteção do emprego.
