Resumo: The present monography takes up in researching and understanding the mediation of conflicts as an instrument for carrying out the fundamental right of access to justice. The usability of mediation of conflicts in Brazil has gained highlight with Resolução nº 125/2010, from National Council of Justice, being recognized as one of the adequate means for resolution of controversies which make up the sistema multiportas, besides being, afterward, object of treatment in Civil Process Code and in Lei de Mediação (Lei nº 13.140/2015), considering that this one highlights itself for, besides other steps, regulate practice of mediation in extrajudicial extent. By means of study of legislation and based in a systematized search of bibliographic references, covering books, theses and articles, the present monography has attempted to answer the following questions: is it possible that the institutionalization of mediation faced with the Brazilian judicial order is indeed able to carry out the adequate treatment of conflicts which stands bail for access jurisdictional tutelage, and able to achieve its purpose of social pacification?

A utilização da mediação de conflitos no Brasil ganhou destaque com a Resolução nº 125/2010, do Conselho Nacional de Justiça, sendo reconhecida como um dos meios adequados para resolução de controvérsias que compõe o sistema multiportas, além de ser, posteriormente, objeto de tratamento no Código de Processo Civil e na Lei de Mediação (Lei nº 13.140/2015), sendo que essa se destaca por, entre outras providências, regulamentar o exercício da mediação em âmbito extrajudicial.
