Refuge request for unaccompanied children and adolescents: the role of the Federal Public Defender’s office

Resumo: The increase in the number of requests for refuge and the migratory flow in general has brought new challenges for the Federal Public Defender’s Office. One of these challenges is related to the treatment that should be given by the Public Defender to migrant children and adolescents unaccompanied in the national territory of their legal responsible. As a way of solving this problem, CONANDA, CONARE, CNIg and DPU published resolution establishing procedures for the immigration regulation, mainly through the request for refuge, and protective measures for this specific group of immigrants. This article aims to analyze this resolution, as well as verify the nature and legitimacy of the action of the Federal Public Defender’s Office in favor of unaccompanied children and adolescents.

Uno de estos retos se refiere al trato que debe dar el Defensor Público a los niños y adolescentes migrantes sin desacompañados en el territorio nacional de su responsable legal. Como solución a este problema, Conanda, Conare, Cnig y DPU publicaron una resolución conjunta en la que se establece procedimientos para la regularización migratoria, principalmente a través de la solicitud de refugio, y medidas de protección para este grupo específico de inmigrantes. El presente artículo tiene por objeto analizar dicha resolución y comprobar la naturaleza y legitimidad de la actuación de la Defensa Pública de la Unión en favor de niños y adolescentes desacompañados.O aumento no número de pedidos de refúgio e do fluxo migratório em geral trouxe novos desafios para a Defensoria Pública da União. Um destes desafios se relaciona com o tratamento que deve ser dado pelo Defensor Público às crianças e adolescentes migrantes desacompanhados em território nacional de seu responsável legal. Como forma de dar solução a este problema, o Conanda, o Conare, o Cnig e a DPU editaram resolução conjunta estabelecendo procedimentos para a regularização migratória, principalmente através do pedido de refúgio, e medidas de proteção a este grupo específico de imigrantes.
