A habermasian view of role performed by Public Defender for the effectiveness of democratic principle in the Inter-American System of Human Rights

Resumo: The present article intends to study the role of the public defenders office to render the democratic principle in the Inter-American System of Human Rights effective, considering Jürgen Habermas’s thought. The democratic principle is intertwined with the popular sovereignty, as well as there is reflection over the habermasian theory of legal discourse. Then, the position of the public defenders office is sketched not only in the Brazilian law, but also in the Inter-American system, including the inter-American public defender office. Finally, an effort has been made to verify the contribution of the public defenders office in the scope of the co-originality relation between human rights and popular sovereignty.

Se expone el principio democrático correlacionándolo con la soberanía popular, así como una reflexión sobre la teoría del discurso jurídico de Habermas. A continuación se perfila la posición de la defensa pública en el plan del derecho interno y en el sistema interamericano, incluso mencionando la defensa pública interamericana. Por último, se realiza un esfuerzo para comprobar la contribución de la defensa en el marco de la relación de cooriginaridad entre los derechos humanos y la soberanía popular.O presente trabalho pretende estudar o papel da defensoria pública para a efetivação do princípio democrático no Sistema Interamericano de Direitos Humanos, considerando o pensamento de Jürgen Habermas. Expõe-se o princípio democrático correlacionando-a com a soberania popular, bem como há uma reflexão sobre a teoria do discurso jurídico de Habermas. Em seguida, delineia-se a posição da defensoria pública no plano do direito interno e no sistema interamericano, inclusive mencionando a defensoria pública interamericana.
