Resumo: This article presents a study of the legal income criteria used for granting the welfare benefit payed to welders and disabled people. It starts with a short historical analysis of the benefit, highlighting the main changes in jurisprudence regarding, especially, the interpretation of the law nº 8742/1993, article 20, §3rd, and the variations on its definition as legal presumption juris et de jure or juris tantum. Then, the article studies the judgment given by the Federal Appeal’s Court in the 4th Region (TRF4) in the IRDR 5013036- 79.2017.4.04.0000/RS, stablishing absolute presumption of misery when the family income per capita fits the legal criteria determined by the law.

Se Inicia con un breve escorzo histórico del instituto, centrándose en las principales alteraciones jurisprudenciales en la materia, en particular por lo que se refiere a la interpretación del §3 del artículo 20 de la ley 8742/1993 y las oscilaciones relativas a la clasificación como presunción juris et de juri o juris tantum. Así pues, el análisis del IRDR 5013036-79.2017.4.04.0000/RS, juzgado por el TRF de la 4ª región, que establece la tesis de la presunción absoluta de miserabilidad en las hipótesis de encuadramiento de la renta per cápita al criterio establecido en la Ley Orgánica de Asistencia Social.O artigo apresenta estudo do benefício assistencial de prestação continuada ao idoso e deficiente no que concerne ao critério de renda legalmente estabelecido para sua concessão. Inicia-se por um breve escorço histórico do instituto, com destaque para as principais alterações jurisprudenciais sobre a matéria, em especial no que concerne à interpretação do §3º do art. 20 da lei 8742/1993 e oscilação referente à classificação como presunção juris et de juri ou juris tantum.
