Elements of legal support on digital accessibility for deaf people in Brazil

Resumo: Studies on digital accessibility have been highlighted throughout the country, and a dialogue with different areas of knowledge, such as Information Science, Technology and Law are required so that accessibility can be effective in our society. In this context, this research aims to present the legal elements that support accessibility actions for the deaf in digital environments available on the internet. For this, we discuss accessibility, presenting its concept and including specific legislation. The study examines the contours of accessibility for deaf people in the field of Information Science, presenting research results in the field of study in Brazil. The adherence of the regulations on digital accessibility to reality is verified, as the approximation of the results produced by the application of the law to social aspirations is recognized. As a methodology, qualitative documentary research is adopted. As results, the legal support on digital accessibility for the deaf is analyzed in the context of occurrences related to federal records, with data collected through the Legislative and Judiciary Information Network (LEXML). The investigation concluded that the regulations that deal with assistive technologies are essential for the implementation of accessibility to digital content available on the internet in order to expand the service to the Brazilian deaf community.

En este contexto, esta investigación tiene como objetivo presentar los elementos legales que sustentan las acciones de accesibilidad para personas sordas en los entornos digitales disponibles en Internet. Para ello, comentamos la accesibilidad, presentando su concepto e incluyendo legislación específica. El estudio examina los contornos de accesibilidad para personas sordas en el campo de las Ciencias de la Información, presentando resultados de investigaciones en el campo de estudio en Brasil. Se verifica el apego de la normativa sobre accesibilidad digital a la realidad, pues se reconoce la aproximación de los resultados que produce la aplicación de la ley a las aspiraciones sociales. Como metodología se adopta la investigación cualitativa documental. Como resultados, se analiza el sustento legal sobre accesibilidad digital para sordos en el contexto de ocurrencias relacionadas con registros federales, con datos recolectados a través de la Red de Información Legislativa y Judicial (LEXML). La investigación concluyó que las normas que tratan sobre las tecnologías de asistencia son esenciales para la implementación de la accesibilidad a los contenidos digitales disponibles en Internet con el fin de ampliar el servicio a la comunidad sorda brasileña.Os estudos sobre acessibilidade digital têm sido evidenciados em todo país, e exige diálogo com diversas áreas do conhecimento, tais como a Ciência da Informação, Tecnologia e o Direito, para que possa ter efetividade no âmbito da sociedade. Nesse contexto, esta pesquisa tem por escopo apresentar os elementos legais que amparam ações de acessibilidade para surdos, em ambiente digital disponível na internet. Para isso, torna-se necessário discorrer sobre acessibilidade, apresentando uma discussão sobre seu conceito, inclusive na legislação específica. Examina-se os contornos da acessibilidade para pessoas surdas no âmbito da Ciência da Informação, apresentando diversos resultados de pesquisa no campo de estudo no Brasil. Averígua-se a adesão das normativas sobre acessibilidade digital à realidade, reconhecendo-a na aproximação dos resultados produzidos pela aplicação da lei às aspirações sociais. Como metodologia adotar-se-á pesquisa qualitativa de caráter documental. Ao final, analisa-se o amparo legal sobre acessibilidade digital para surdos no âmbito das ocorrências relacionadas aos registros federais, tendo os dados coletados por meio da Rede de Informação Legislativa e Judiciária (LEXML).
