Resumo: | The general objective of this article is to critically analyze the provisions of Bill 632/2020, authored by Brazilian Senator Jorge Kajuru (CIDADANIA/GO), which intends to make the disclosure of information false, defamatory or “unfounded” as an act of administrative improbity and a responsibility crime. Through a case study, with a review of the literature on constitutional and administrative matters involved, it seeks to assess whether there is a thematic link between the disclosure of false information and an act of administrative impropriety. Based on the deductive method, the article finds that there is a failure to observe the principles of proportionality and reasonableness in an attempt to classify the disclosure of false information as a responsibility crime, subjecting the political agent who proceeds in this way to loss and disqualification for the position. Thus, since the damage caused by the disclosure of untrue content is indisputable, it remains to be seen whether this is the best legal way to face the growing problem of disinformation. |

Thus, since the damage caused by the disclosure of untrue content is indisputable, it remains to be seen whether this is the best legal way to face the growing problem of disinformation.Este artigo tem como objetivo geral analisar, de forma crítica, as disposições do Projeto de Lei nº 632/2020, de autoria do senador Jorge Kajuru (CIDADANIA/GO), que pretende tornar a divulgação de informação falsa, difamatória ou “sem fundamento” como ato de improbidade administrativa e crime de responsabilidade. Por meio de um estudo de caso, contando com revisão de literatura sobre assuntos constitucionais e administrativos envolvidos, busca-se aferir se há uma vinculação temática entre a divulgação de informações falsas e ato de improbidade administrativa. A partir do método dedutivo, o artigo constata que há uma inobservância aos princípios da proporcionalidade e razoabilidade na tentativa de classificar a divulgação de informações falsas como crime de responsabilidade, sujeitando o agente político que procede dessa forma à perda e inabilitação para o cargo.
