Effectiveness against third parties of private mediation regardless of judicial approval

Resumo: The article aims to demonstrate the effectiveness against third parties of mediation agreements between private parties, regardless of judicial approval, invoking jurisprudence of the Superior Court of Justice, which refuses to ratify extrajudicial transactions. In Brazil, it is usual to ratify in court agreements subject to private negotiations, a practice that interested parties seek to extend to the final terms of mediation. The trend towards de-judicialization reinforces the principle of inescapability of jurisdiction, established in the Constitution (art.5, XXXV), by reserving judges and courts for the judgment of indisputably contentious cases. The interconnection to the notary-registry system of the extrajudicial enforceable title, arising from mediation agreements, facilitates the fulfillment of obligations, given the general effects of publicity and public faith, different from the scope of res judicata, restricted to the parties to the process, and always post -conflictual.

En Brasil, es habitual la ratificación judicial de acuerdos sujetos a negociación privada, práctica que los interesados ​​buscan extender hasta los términos finales de la mediación. La tendencia a la desjudicialización refuerza el principio de ineludibilidad de la jurisdicción, consagrado en la Constitución (art. 5, XXXV), al reservar a jueces y tribunales para la sentencia de casos indiscutiblemente contenciosos. La interconexión al sistema notarial-registral del título ejecutivo extrajudicial, derivada de convenios de mediación, facilita el cumplimiento de las obligaciones, dados los efectos generales de publicidad y fe pública, distintos del ámbito de cosa juzgada, restringidos a las partes del proceso. y siempre posconflicto.O artigo visa demonstrar a eficácia contra terceiros dos acordos de mediação entre particulares, independente de homologação judicial, invocando jurisprudência do Superior Tribunal de Justiça, que recusa homologar transações extrajudiciais. No Brasil, é usual homologar-se em juízo acordos objeto de negociações privadas, prática que os interessados buscam estender aos termos finais de mediação. A tendência à desjudicialização reforça o princípio da inafastabilidade da jurisdição, positivado na Constituição (art.5º, XXXV), por reservar juízes e tribunais ao julgamento dos casos indiscutivelmente litigiosos.
