Resumo: | The article aims to demonstrate the effectiveness against third parties of mediation agreements between private parties, regardless of judicial approval, invoking jurisprudence of the Superior Court of Justice, which refuses to ratify extrajudicial transactions. In Brazil, it is usual to ratify in court agreements subject to private negotiations, a practice that interested parties seek to extend to the final terms of mediation. The trend towards de-judicialization reinforces the principle of inescapability of jurisdiction, established in the Constitution (art.5, XXXV), by reserving judges and courts for the judgment of indisputably contentious cases. The interconnection to the notary-registry system of the extrajudicial enforceable title, arising from mediation agreements, facilitates the fulfillment of obligations, given the general effects of publicity and public faith, different from the scope of res judicata, restricted to the parties to the process, and always post -conflictual. |
