Resumo: The recognition of the democratic right to catch water as Paradox and challenge of globalisation: new subject of rights in the exercise of active citizenship to certainly be granted self-determination within the use and water resources co-management as State policy. Redraws the subject of rights as a fellow-citizen, endowed with decision-making power that is no longer exclusive to the State, in which the subjects ‘ activism takes body, not only as recipients, but also a co-responsibility for managing the environment, in the right-duty to care for and manage the environment of life, to participate in the economic and political life of society in legal expression of a pluralism that opposes state regulation and centrality of production standards and rights. The problematic contained water democracy – individual and community access and co-management. Are presented the experiences of popular participation in water policies, since the international until the performance in a hydrographic watershed.

Redesenha-se o sujeito de direitos como um sujeito-cidadão, dotado de poder decisório já não mais exclusivo do Estado, em que o ativismo dos sujeitos toma corpo, não somente como destinatários, mas também corresponsáveis pela gestão do meio ambiente, no direito-dever de cuidar e administrar o ambiente da vida, de participar da vida política e econômica da sociedade na expressão jurídica de um pluralismo que se opõe à centralidade estatal na regulação e produção de normas e direitos. A problemática ínsita à democracia hídrica – acesso e cogestão individual e comunitária.
