Resumo: | This text aims to reconstruct the requirements of the initial pleading [initial petition] from some of the pillars of the New Civil Procedure Code (CPC) and their fundamental norms, in order to emphasize some non-explicit modifications in its normative text. Although the text of articles 319 and 106, I, of the New CPC is similar to the text of articles 282 and 39, I, of the reformed CPC, is possible to see significant modifications in understanding of elaboration technique of the initial pleading, modifications not be explicit in the code. This fact derives from the circumstance that the New CPC should be interpreted systematically and considered in its unity, cannot be interpretations of regulatory provisions and institutes in isolation. |

Muito embora o texto dos artigos 319 e 106, inciso I, do Novo CPC seja similar ao texto dos artigos 282 e 39, inciso I, do CPC reformado, é possível enxergar mudanças significativas na compreensão da técnica de elaboração da petição inicial, mudanças essas não explícitas no Código.
