PERSONS WITH DISABILITY AND THE RIGHT TO EDUCATION: AN INCLUSIVE PERSPECTIVE FROM THE STATE OF SÃO PAULO

Resumo: This article aims to analyze the law governing rights of persons with disabilities in school age, considering relating the law published in the federal sphere, the São Paulo State law and the contemporary perspective of the guarantee and advocacy on behalf of people with special educational needs’ school inclusion. As a result of the analysis, it was realized that the understanding of the specialized teaching support’s character diverges at the federal and state spheres. It was found a latent presence of the subject-matter of this research in the educational laws of both administrative spheres researched, always identified by the preference of attendance in the regular education network, with specialist support provided at the extra-curricular classes in the regular education.

It was found a latent presence of the subject-matter of this research in the educational laws of both administrative spheres researched, always identified by the preference of attendance in the regular education network, with specialist support provided at the extra-curricular classes in the regular education.Neste artigo, objetiva-se analisar a legislação que disciplina os direitos das pessoas com deficiência em idade escolar, buscando relacionar a legislação editada em âmbito federal, a legislação estadual de São Paulo e a perspectiva contemporânea da garantia e defesa de direitos em prol da inclusão escolar de pessoas com necessidades educacionais especiais. Como resultado da análise, percebeu-se que o entendimento sobre o caráter do apoio pedagógico especializado diverge nas esferas federal e estadual.
