The federative (dis)articulation in penal policy agenda: an analysis of federal grants from funpen to state governments

Resumo: This paper analyzes the profile of intergovernmental relations promoted by the National Penitentiary Department (DEPEN) with state governments between the years of 2006 to 2016. We start from the hypothesis that different strategies were established around the creation of federal programs and their link to the transfer of financial resources to state governments via the National Penitentiary Fund (FUNPEN). On the one hand, federative coordination was sought by inducing certain types of criminal liability – as is the case with criminal alternatives. On the other hand, DEPEN acted in the logic of cooperation by complementing actions carried out by state governments – such as the provision of places in prisons. Through documental research and a survey of the agreements signed, we concluded that the federal government is not the protagonist in the criminal policy agenda, since its performance in the studied period was diffuse, and this choice made it difficult to condition the DEPEN technical guidance guidelines for the transfer of financial resources from FUNPEN in a proposal for federative coordination.

Partimos da hipótese que foram estabelecidas estratégias distintas em torno da criação de programas federais e a vinculação desses ao repasse de recursos financeiros para os governos estaduais via Fundo Penitenciário Nacional (FUNPEN). Por um lado, buscou-se a coordenação federativa ao induzir certos tipos de responsabilização penal – como é o caso das alternativas penais. Por outro lado, o DEPEN atuou na lógica da cooperação via complementação de ações executadas pelos governos estaduais – como é o caso da provisão de vagas em estabelecimentos prisionais.
