Resumo: | From the strengthening and complexity of international trade, agreements and organizations were born. They were in charge of regulating and directing international trade fairly and equitably across countries with different socioeconomic indexes. At first, the General Agreement on Tariffs and Trade (GATT) met this challenge, being replaced in a second moment by the World Trade Organization (WTO), the most comprehensive and dynamic supranational body as to the current needs. To circumvent the trade disputes between its members, the WTO has a dispute resolution system, whose structure consists of two jurisdictional courts, which analyze and judge cases involving commercial disputes. The system follows its own procedures similar to a legal procedure. Based on general principles and impartiality, its courts act in the sphere of the agreements, overseeing their fulfillment and delivering sentences of mandatory and binding nature. Num primeiro momento, o Acordo Geral de Tarifas e Comércio (GATT) cumpriu tal desafio, sendo substituído, num segundo momento, pela Organização Mundial do Comércio (OMC), órgão supranacional mais abrangente e dinâmica quanto às necessidades atuais. Para contornar os conflitos comerciais entre seus membros, a OMC conta com o sistema de solução de controvérsias, estrutura constituída por dois órgãos jurisdicionais, que analisam e sentenciam casos envolvendo disputas comerciais. O sistema segue procedimentos próprios semelhantes a um rito processual.
