Resumo: This paper aimed to analyze the enforcement process of human rights international treaties by the Federal Supreme Court from the years 2001 to 2013. The jurisprudence database was used which is available in the Federal Supreme Court’s website in order to gather information on the common characteristics of previous subjects who called on these international treaties. It was possible to observe that the use of these human rights international treaties by the Federal Supreme Court has gradually increased throughout these 13 years. However, the performance has been preponderantly restricted to the protection of dimension individual rights over social and economical rights. In this way, political philosophy matters were discussed about the role of a Federal Court to comprehend the causes of this phenomenon which has caused the acknowledgment of a hermeneutics crisis. It prevents the usage of all the transforming potential of the human rights international treaties by the Constitutional authority.

It prevents the usage of all the transforming potential of the human rights international treaties by the Constitutional authority.O presente estudo objetivou analisar o processo de implementação dos tratados internacionais de direitos humanos pelo Supremo Tribunal Federal entre os anos de 2001 e 2013. Utilizou-se do banco de jurisprudência disponibilizado no sítio eletrônico da Suprema Corte para levantar dados acerca das características comuns dos precedentes que invocaram esses tratados internacionais, meio pelo qual se observou que a utilização dos tratados internacionais dessa natureza nos precedentes da Corte tem aumentado progressivamente no decorrer dos últimos 13 anos, mas também tem se restringido, preponderantemente, à proteção dos direitos de primeira dimensão, em detrimento dos direitos sociais e econômicos.
