Resumo: The complexity of social relations requires from the Law the task of distributing scarce resources, realizing social justice. The decision on this distribution is a work in which generally the popular will is measured by checking the consent of the greater part of the people. Nevertheless, some decisions must be taken away from the majorities and can not be taken by electives bodies, especially those which are concerned about fundamental rights and rights of minorities. This approach aims to analyze the mission which Public Advocacy of State has to enable that state decisions are taken according to society and within constitutional limits
