Resumo: The text presents defined theoretical frameworks, which constitute the most recent in the general theory of law, and exposes a concept for one of the most discussed expressions in the area, namely, legal norm, which comes to be confused with the law itself. law concept. Although connecting it with the origins of Western thought, it abandons the traditional conceptions of neo-Kantian origin and starts from a functionalist context, which places the norm as a strategy for controlling complexity, understood as an expectation for the future. It seeks to draw attention to the existential and anthropological aspect of norms, as part of human rationality, and to complement the functionalist view through a rhetorical perspective of expectations as linguistic constructions.

Embora conectando-o com as origens do pensamento ocidental, abandona as concepções tradicionais de origem neokantiana e parte de um contexto funcionalista, que coloca a norma como uma estratégia para controle de complexidade, entendida como expectativa quanto ao futuro.
