Resumo: Initially, it should be stressed that the benefits of the awarded sentence are appropriate even during the execution process. This statement stems from the teleological interpretation of the norms that instituted the winning sentence, after all the main objective of the benefit for the State remains after the condemnation of the whistleblower. Furthermore, since the legislator did not expressly forbid the award in the execution phase, it would not be up to the interpreter to reduce the scope and effectiveness of the institute.
