Resumo: The purpose of this article is to analyze and challenge the lack of legal certainty in article 28, second paragraph of the drug law in force since 2006. The analysis is given critically over jurisprudential facts and doctrines related to the theme in order to highlight the existing legal uncertainty and show the groups at risk of this failure by the legislator. Then, explain why it occurs and what would be the solution to this problem in the light of Brazilian criminal law
