This study aims to analyze the possible mechanisms to extend protection to the exploitation of the work carried out by the new insurgent business models in the so-called sharing economy. The company Uber, considered a pioneer in the propagation of urban private transportation service, stood out because of the dynamics adopted to carry out the work offered, giving rise to what is being called uberization of labor relations and will be used as a premise for reflection proposal. In this measure, the attempt to define the nature of the juridical relationship between the Companies-applications x Drivers-partners and the explanation of how the Judiciary's understanding of labor lawsuits is concerned, in the face of the filing of actions that relate to recognition of employment ties. Given the absence of specific parameters and limits of performance of these companies, it is necessary to investigate to what extent the dynamics of these new business models lead to the precariousness of work. With the application of international norms in labor law, constitutional rights and guarantees, this research seeks the widest possible scope of protection for the protagonists of the relationship presented: the worker in the sense lato sensu. It is a bibliographic research of a qualitative nature, with allusive doctrinal contribution and other materials published in books, scientific articles and survey of the juridical devices related to the presented proposal. The method that fits the development of this research is the dialectical method. The juridical-social aspect of the problem remains evident, since the content transcends the letter of the law and reaches problematic of international scope.
