Resumo: The present study sought to analyze in depth the institute of special arrest in the Brazilian legal system, which aims to guarantee special treatment to certain individuals until the res judicata of their sentences, protecting them from the maladies of the common prisons cells because of the functions which were held before the prison, focusing on the prerogative of special arrest for the holder of a higher education diploma, which will be constantly questioned by virtue of its discriminatory and discriminatory nature, segregating citizens based on their socio-cultural level, will also be the historical aspect of the principle of isonomy and special arrest, as well as the staff room and the house arrest, as well as a brief sociological analysis of the context of the Brazilian prisons and the problems found in them, difficulty in maintaining one of the largest prison populations s of the world.
