Resumo: This monograph aims to analyze the criminal liability of with Antisocial Personality Disorder, that is, to present the thesis majority in Brazil today as to their imputability. From start, Introductory, there is the presentation and analysis of the Theory of Crime in Brazil, since from this one has the configuration of the crime, and, only from there, the possibility of imputing criminal responsibilities to any citizen. There is still a psychiatric study of psychopaths, that is, analysis of the influence of the disorder in their lives and in their possible criminal acts. Furthermore, the presentation of judgments and positions of important scholars will demonstrate, mostly, that the judiciary Brazil treats the psychopath as a common defendant, that is, he is imputable, that is, mainly because of his total capacity to be aware of the illegality of his acts, the which rules out the hypothesis of non-imputability or semi-imputability. However, some scholars and magistrates choose to classify sociopaths as semi-attributable, this directly culminates in the possibility of them being sanctioned with security measures and psychological treatments. Finally, there is evidence of a duality in the positioning of the Brazilian judiciary regarding the punitive character of the penalties granted to psychopaths, so that discussions about possible changes in this scenario are latent in the legal scope Brazilian

De início, introdutoriamente, tem-se a apresentação e análise da Teoria do Crime no Brasil, haja vista que a partir desta tem-se a configuração do delito, e, só a partir dele, a possiblidade de imputar-se responsabilidades penais a algum cidadão. Tem-se, ainda, um estudo psiquiátrico dos psicopatas, ou seja, análise quanto a influência do distúrbio na vida deles e em seus possíveis atos criminosos. Ainda, a apresentação de julgados e posições de importantes doutrinadores demostrarão, majoritariamente, que o judiciário Brasil trata o psicopata como um réu comum, ou seja, ele é imputável, isto, principalmente pela sua total capacidade de consciência de ilicitude de seus atos, o que afasta a hipótese de inimputabilidade ou semi-imputabilidade. Não obstante, alguns doutrinadores e magistrados optam por classificarem os sociopatas como semi-imputáveis, isto culmina, diretamente, na possibilidade de estes serem sancionados com medidas de seguranças e tratamentos psicológicos.
