Resumo: The model of administration of public hospitals set by the São Paulo state government through the complementary law passed on June, 4th 1998 has settled an important issue: to provide the civil service with the same managerial tools available to private organizations. This model was developed in the context of the 1994 Brazilian State reform, which proposed a managerialreform of the public administration. This model enabled those hospitals conceived by 1985 Metropolitan Health Program to be run by non-profit organizations acknowledged by their work in the public health sector, certified as social healthcare organizations. The most important tool of this model is the management contract, where one establishes the rules of financing, volume and mix of services provided, evaluation criteria of productionand quality assurance. The model was criticized as a way of privatization of the public health services, and for its lack of transparency and social control. The results have been considered satisfactory by the government because of the system’s fast deployment and the high quality of the services provided. Actually, the management contract allowed clear visibility and transparency in the use of public resources, the necessary condition for social control. The adequate use of public services can only be guaranteed under a democratic state and complete citizenship.

The adequate use of public services can only be guaranteed under a democratic state and complete citizenship.O modelo de administração de hospitais públicos através das organizações sociais de saúde, implantado no âmbito do governo do estado de São Paulo pela Lei Complementar nº 846, de 4 de junho de 1998, veio equacionar uma importante questão, que é a de conceder à administração pública os mesmos instrumentos gerenciais disponíveis à administração privada. Esse modelo foi desenvolvido no contexto da reforma do Estado brasileiro a partir de 1994, a qual propunha a implantação de uma administração pública gerencial. Através desse modelo, os hospitais concebidos pelo programa metropolitano de saúde de 1985 passaram a ser administrados por entidades privadas sem fins lucrativos, com reconhecida capacidade na área da saúde, qualificadas como organizações sociais de saúde. O principal instrumento desse modelo é o contrato de gestão, através do qual são estabelecidas as regras de repasse financeiro, o volume e os tipos de serviços prestados e os critérios de avaliação de produção e de qualidade desses serviços. Esse modelo foi criticado como uma forma de privatização dos serviços de saúde, considerado pouco transparente e acusado de não permitir o controle social. Os resultados apresentados são considerados bem-sucedidos pelo governo pela sua rápida implantação e pela qualidade dos serviços prestados. Na verdade, o contrato de gestão permitiu uma clara visibilidade e transparência do uso dos recursos públicos, condições estas necessárias ao controle social.
