Administrative Reforms in Brazil: past, present, and future perspectives following PEC 32/2020

Resumo: | The aim of this article is to analyze the Constitutional Amendment Proposal (PEC) 32/2020, both quantitatively and qualitatively. To undertake the analysis, first we review the literature on Public Administration reforms, while contextualizing the proposal accordingly in the Brazilian history of administrative reforms. Second, we undertake a two-step analysis of PEC 32/2020’s contents: the first consists in a systematic content analysis based on word counting, according to categories of public management policies and design of programmatic organizations. The second step consists of the qualitative analysis of the proposed changes to the constitutional principles of Public Administration and human resources management (competition, stability, commission charges, and performance). The results of the analysis show that, by dedicating more than half (53%) of the total content and 74% of its effective content (substantive provisions) to work issues of public servants, the proposal (PEC 32/2020) would be better labelled as a “civil service reform,” and not as an “administrative reform.” Regarding the new proposed constitutional principles, there is redundancy between them, especially linked to the fundamental right to good governance. Finally, we reiterate the timeliness and relevance of the discussion about the hiring process of public employees, tenure and stability for employees, appointed positions, and performance evaluation, as long as they are aligned with the ethical and constitutional principles of public service as a societal value, institutionalized to the legal system and continuously responding to the population’s welfare needs. |

Primero, se presenta una revisión de la literatura sobre reformas en la administración pública y el rescate histórico de reformas en la Administración Pública federal brasileña. En segundo lugar, la PEC 32/2020 se analiza en dos etapas: en la primera, se realiza un análisis sistemático de contenido con base en el recuento de palabras y codificación según categorías de políticas de gestión pública y diseño de organizaciones programáticas. En la segunda parte, se profundiza en el análisis cualitativo de los cambios propuestos a los principios constitucionales de la Administración Pública y la gestión de personas (competencias, estabilidad, cargos designados y desempeño). Se concluye que, al dedicar más de la mitad (53 %) de su contenido total, y el 74 % de su contenido efectivo (disposiciones sustantivas), la propuesta PEC 32/2020 podría recibir la etiqueta de "reforma de relaciones laborales" en lugar de "reforma administrativa". En cuanto a los nuevos principios constitucionales, existe una redundancia entre ellos, especialmente vinculada al derecho fundamental a la buena gobernanza. Finalmente, se reiteran la oportunidad y relevancia de la discusión de los modelos de concurso público, estabilidad del servidor, funciones designados y evaluación de prestaciones, siempre que estén en sintonía con un entendimiento ético y constitucional del servidor y el servicio público como activo de la sociedad, incorporado al sistema legal y respondiendo continuamente a las necesidades de bienestar de la población.O objetivo deste artigo é analisar quantitativamente e qualitativamente a PEC 32/2020, apontando aspectos críticos de formulação e decisão. Primeiro, parte-se de uma revisão da literatura em reformas da administração pública e do resgate histórico de reformas na Administração Pública federal brasileira. Segundo analisa-se a PEC 32/2020 em duas etapas: na primeira é realizada uma análise sistemática de conteúdo a partir da contagem de palavras e codificação destas de acordo com categorias de políticas de gestão pública e desenho de organizações programáticas. Na segunda parte, aprofunda-se na análise qualitativa sobre as propostas de alteração de princípios constitucionais da Administração Pública e da gestão de pessoas (concurso, estabilidade, cargos em comissão e desempenho). Conclui-se que, por dedicar mais da metade (53%) do conteúdo total da PEC 32/2020, e 74% do seu conteúdo efetivo (dispositivos substantivos) para a regulamentação da relação de trabalho com o servidor público, a etiqueta que melhor representaria o seu conteúdo seria reforma do funcionalismo público, ao invés de Reforma Administrativa. Com relação aos novos princípios constitucionais, verifica-se redundância entre eles, especialmente ligados ao direito fundamental à boa governança.
