Resumo: ABSTRACTThis study analyzes the normative dimensions of certifications given by the government to civil society organizations of public interest. It also concisely explores the contextual complexities that permeate the contemporary. The certifications in discussion are those at the federal level: Civil Society Organization of Public Interest (OSCIP), Federal Public Utility (UPF), and Certification of Beneficent Organization of Social Assistance (CEBAS). An exploratory and documental research study was developed mainly drawing from the analysis of laws as well as scientific and governmental reports regarding the subject. By drawing a normative-contextual overview of the certifications, the study provides a practical-reflexive approach for scholars, practitioners and others interested in civil society organizations. Since a bill about a novel legal instrument in relations between government and non-profit organizations - the Fostering and Collaboration Term - is currently ready for approval by the Legislative under the aegis of a new regulatory framework, consequences to the current system of certifications discussed throughout this study are expected.Keywords: Civil society organizations. Public certifications.RESUMENEste estudio analiza las dimensiones normativas de las certificaciones concedidas por el Estado a las organizaciones de la sociedad civil que actúan a favor del interés público, así como también explora concisamente las complejidades contextuales que las permean en la contemporaneidad. Son abordadas las certificaciones en ámbito federal, las cuales son: Organización de la Sociedad Civil de Interés Público (OSCIP), Utilidad Pública Federal (UPF) y Certificado de Entidad Benefactora de Asistencia Social (CEBAS). Se trata de un estudio exploratorio y documental, basado, principalmente, en el análisis de legislaciones y de informes científicos y gubernamentales sobre el tema. Al proveer un panorama normativo-contextual sobre las certificaciones, el estudio encuentra aplicación práctico-reflexiva para estudiosos, profesionales y otros interesados en las organizaciones de la sociedad civil. Dado que el proyecto de ley se trata de un instrumento legal alternativo en las relaciones entre Estado y organizaciones de la sociedad civil - el Término de Fomento y Colaboración - está cerca de ser aprobado dentro de un nuevo marco regulatorio, se esperan consecuencias para el actual sistema de certificaciones objetivo de este estudio.Palabras clave: Organizaciones de la sociedad civil. RESUMOEste estudo analisa as dimensões normativas das certificações concedidas pelo Estado às organizações da sociedade civil que atuam em prol do interesse público, assim como explora concisamente as complexidades contextuais que as permeiam na contemporaneidade. São abordadas as seguintes certificações em âmbito federal: Organização da Sociedade Civil de Interesse Público (Oscip), Utilidade Pública Federal (UPF) e Certificado de Entidade Beneficente de Assistência Social (Cebas). Trata-se de pesquisa exploratória e documental, com base, principalmente, na análise de legislações e de relatórios científicos e governamentais sobre o tema. Ao prover um panorama normativo-contextual sobre as certificações, o estudo encontra aplicação prático-reflexiva para estudiosos, profissionais e outros interessados nas organizações da sociedade civil. Tendo em vista que o projeto de lei que trata de um alternativo instrumento legal nas relações entre Estado e organizações da sociedade civil – o Termo de Fomento e Colaboração – está próximo de ser aprovado sob a égide de um novo marco regulatório, consequências são esperadas para o atual sistema de certificações, foco deste estudo.Palavras-chave: Organizações da sociedade civil, Estado, Certificações públicas.
