Resumo: Medicinal plants are worldly spread deal to keep or to recover the health, including in Brazil where they are widely used. Products obtained from medicinal plants are regulated by the National System of Health Surveillance, which is coordenated by Nacional Health Surveillance Agency (ANVISA). As a pharmaceutical product, there are many ways to classify phytotherapics: medicinal plants, notificated vegetal drugs, industrialized or manipulated herbal medicines. In the other hand, medicinal plants could be used in manufacturing of cosmetics and foods. The health control for these products by ANVISA is different and depend on how they are produced or their exigency degree related to safety, eficacy or quality defined in law. The different categories and the specific regulation for this products are discussed in this article.

O uso de produtos obtidos de plantas medicinais, denominados fitoterápicos, é regulamentado nacionalmente pelo Sistema Nacional de Vigilância Sanitária (SNVS), coordenado pela Agência Nacional de Vigilância Sanitária (ANVISA). Existem diversas formas possíveis de regulamentação para os fitoterápicos: plantas medicinais, drogas vegetais notificadas, medicamento fitoterápico manipulado e industrializado, e, fora da área farmacêutica, as plantas medicinais possuem possibilidade de uso como cosmético ou alimento. O controle sanitário desses produtos pela ANVISA difere de acordo com a forma que é preparado o produto obtido de plantas medicinais ou com o grau exigido de segurança, eficácia e qualidade para o produto.
