Resumo: Objective: analyze the connections between prison sentences and death, based on the deaths that occur due to illnesses in the prisons of the state of São Paulo, trying to relate them to the prisons’ own operating conditions, a scenario that worsened during the COVID-19 pandemic. Methodology: based on documentary research, 27 cases of requests for house arrest made by the Public Defender's Office of the State of São Paulo for people from risk groups were examined. Results: the results demonstrate mismatch between the actions of the criminal justice system and the magnitude of the health crisis that has plagued the country, culminating with requests for house arrest being made after the death of the inmates. Conclusion: the prison system and the criminal justice system operate as central factors in the production of death.

Metodología: a partir de una investigación documental, se examinaron 27 casos de solicitudes de arresto domiciliario realizadas por la Defensoría Pública del Estado de São Paulo para personas de grupos de riesgo. Resultados: los resultados demuestran un desajuste entre las acciones del sistema de justicia penal y la magnitud de la crisis sanitaria que asoló el país, culminando en solicitudes de arresto domiciliario formuladas tras la muerte de los internos. Conclusión: el sistema penitenciario y el sistema de justicia penal operan como factores centrales en la producción de la muerte.Objetivo: analisar as relações entre pena de prisão e morte, a partir dos óbitos que ocorrem por doenças nos presídios do Estado de São Paulo, buscando relacioná-los às próprias condições de funcionamento das prisões, cenário que se agravou durante a pandemia de COVID-19. Metodologia: com base na realização de pesquisa documental, examinou-se 27 casos de pedido de prisão domiciliar feitos pela Defensoria Pública do Estado de São Paulo para pessoas de grupos de risco. Resultado: os resultados demonstram um descompasso entre as ações do sistema de justiça criminal e a magnitude da crise sanitária que assolou o país, culminando com pedidos de prisão domiciliar feitos após a morte dos presos.
