The minimum existential of the right to health in the SUS: the Family Health Program case

The positive dimension of the social rights leads to its recognition as rights to essential material installments to the minimum conditions of survival. This understanding raises the picture of an existential minimum as condition for the worthy existence of the individual. Amongst the social rights, this paper discusses the right to health, for being the fundamental right to life and for understanding it as a prerequisite for the full development of other social rights. This article aims to analyze the existential minimum entitlement in the case of the Family Health Program (FHP). It consisted of an exploratory study, with qualitative approach, on right to the existential minimum in the case of the Family Health Program, conducted through literature review concerning the minimum existential theory and legislative research on the FHP. 21 publications have been selected. On legislative research, 40 rules were identified, but only one ministerial order has been selected. One of the ways of accomplishing the existential minimum of the right to health is by means of the creation and implementation of public policies, such as the FHP. The guarantee of this right implies a minimum parameter to its effectiveness, preventing the omission on the part of the State.
