Resumo: The general objective of this article is to investigate the collective protection of the consumer in court in Brazil under the specific focus of public civil action that discusses the alteration of the rules of air transport, through the dialogue between the sources between the CDC and the Antitrust Law. We proceeded with the study of consumer protection institutes linked to changes in the rules of air transport, recognizing also that the principles of defense of competition have as a background, in addition to the application of the constitutional principle of free initiative, the defense of the final recipient, consumer protection, given the tendency to consolidate oligopolies capable of sharpening technical, economic and informational vulnerability to the detriment of the weak player in this relationship. The methodology used was the analysis of documents and the specialized bibliography on the subject, in addition to the analysis of judges. In the specific case that was intended to be analyzed, it was seen that the position defended by the consumer protection agency in the collective action was that the Regulatory Agency should restrict the freedom of the air transport market proposed in Resolution No. 400 of the National Agency of Civil Aviation, in order to defend this weak player in the relationship, given the economic exploitation that he started to suffer through the deregulation of services. It was understood in the present reason, that the confessed deregulation of the air transport service weakened the condition of the passenger and heightened the peculiar vulnerability of the respective consumption relationship, instead of having diametrically opposite effects, insofar as the expansion of competition did not occur. , nor did it result in a reduction in ticket prices, failing to include the various segments and profiles of the contractors (both passengers and companies), failing to contribute to the resumption of growth in the sector, whose maintenance of the previous normative premises ( historically conceived in another era, register), imposing excessive burden on contractors.

Se procedió al estudio de los institutos de protección al consumidor vinculados a cambios en las normas de transporte aéreo, reconociendo también que los principios de defensa de la competencia tienen como antecedente, además de la aplicación del principio constitucional de libre empresa, la defensa del destinatario final. , la protección del consumidor, dada la tendencia a la consolidación de oligopolios capaces de agudizar la vulnerabilidad técnica, económica e informativa en detrimento del jugador débil de esta relación. La metodología utilizada fue el análisis de documentos y bibliografía especializada sobre el tema, además del análisis de juicios. En el caso específico que pretendíamos analizar, se vio que la posición defendida por la agencia de protección al consumidor en la acción colectiva fue que la Agencia Reguladora debe restringir la libertad del mercado del transporte aéreo propuesta en la Resolución No. 400 de la Agencia Nacional. de Aviación Civil, con el fin de defender a este actor débil en la relación, dada la explotación económica que comenzó a sufrir a través de la desregulación de los servicios. Se entendió en este razonamiento que la admitida desregulación del servicio de transporte aéreo debilitó la condición del pasajero y agudizó la peculiar vulnerabilidad de la respectiva relación de consumo, en lugar de tener efectos diametralmente opuestos, ya que no hubo incremento de competencia, ni tampoco resultan en la reducción de los precios de los pasajes, al no contemplar los distintos segmentos y perfiles de los contratistas (tanto de pasajeros como de empresas), no contribuyendo además a la reanudación del crecimiento del sector, cuyo mantenimiento de los supuestos normativos anteriores (históricamente concebidos en otro era, tenga en cuenta), impuso cargas excesivas a los contratistas.L'objectif général de cet article est d'étudier la protection collective des consommateurs devant les tribunaux au Brésil dans le cadre spécifique de l'action civile publique qui discute du changement des règles du transport aérien, à travers le dialogue de sources entre la CDC et la loi antitrust. Nous avons procédé à l'étude des instituts de protection des consommateurs liés à l'évolution des règles du transport aérien, en reconnaissant également que les principes de défense de la concurrence ont pour toile de fond, outre l'application du principe constitutionnel de libre entreprise, la défense du bénéficiaire final , la protection du consommateur, compte tenu de la tendance à la consolidation d'oligopoles susceptibles d'accentuer la vulnérabilité technique, économique et informationnelle au détriment de l'acteur faible de cette relation. La méthodologie utilisée a été l'analyse de documents et de bibliographies spécialisées sur le sujet, en plus de l'analyse des jugements. Dans le cas précis que nous avions l'intention d'analyser, on a vu que la position défendue par l'agence de protection des consommateurs dans l'action collective était que l'agence de régulation devrait restreindre la liberté du marché du transport aérien proposée dans la résolution n° 400 de l'agence nationale de l'aviation civile, afin de défendre cet acteur faible dans la relation, compte tenu de l'exploitation économique qu'il a commencé à subir à travers la dérégulation des services. Il était compris dans ce raisonnement que la déréglementation admise du service de transport aérien affaiblissait la condition du passager et accentuait la vulnérabilité particulière de la relation de consommation respective, au lieu d'avoir des effets diamétralement opposés, car il n'y avait pas d'augmentation de la concurrence, ni aboutir à la réduction des prix des billets, en négligeant d'envisager les différents segments et profils d'entrepreneurs (tant voyageurs que compagnies), en ne contribuant pas non plus à la reprise de la croissance du secteur, dont le maintien des hypothèses normatives antérieures (conçues historiquement dans un autre ère, veuillez noter), imposaient des charges excessives aux contractants.O objetivo geral deste artigo consiste em investigar a tutela coletiva do consumidor em juízo no Brasil sob o enfoque específico de ação civil pública que discute a alteração das regras do transporte aéreo, através do diálogo das fontes entre o CDC e a Lei Antitruste. Procedeu-se com o estudo dos institutos de defesa do consumidor ligados às alterações das regras do transporte aéreo, reconhecendo-se também que os princípios de defesa da concorrência têm como pano de fundo, além da aplicação do princípio constitucional da livre iniciativa, a defesa do destinatário final, a tutela do consumidor, dada a tendência de consolidação de oligopólios capazes de aguçar a vulnerabilidade técnica, econômica e informacional em desfavor do player fraco dessa relação. A metodologia utilizada foi a análise de documentos e da bibliografia especializada sobre o tema, além da análise de julgados. No caso concreto que se pretendeu analisar, viu-se que a posição defendida pelo órgão de defesa do consumidor na ação coletiva foi no sentido de que a Agência Reguladora deveria restringir a liberdade do mercado de transporte aéreo proposta na Resolução nº 400 da Agência Nacional de Aviação Civil, a fim de defender este player fraco da relação, haja vista a exploração econômica que este passou a sofrer mediante a desregulação dos serviços.
