Resumo: The research problem concerns the relation between the Legislative function and the judiciary. These variables are related to the extent that the relationship between State and Society, at modern democracy, was built as a relationship based on the principles of separation of functions and representativeness. Thereby, it intends to indicate the rationalization of the legislative process, the proposal presented by the Legisprudence, as a possible way to reduce the scope of the judicial review. Thus, the deductive method will be used through bibliographic research, with interdisciplinarity between Political and Legal Sciences for the implementation of the proposal in study. It is also indicated that the proposed rationalization of the legislative process, more effectively demarcates the justifications for selecting a particular option for legislative thrust.

Essas variáveis associam-se na medida em que a relação entre Estado e Sociedade, na democracia moderna, tem sido permeada pelos princípios da separação das funções fundamentais do Estado e da representatividade. Assim, buscou-se testificar a proposta de racionalização do processo legislativo como hipótese para redução da abrangência da judicialização da política. Para tanto, utilizar-se-á o método dedutivo por meio da pesquisa bibliográfica, com interdisciplinaridade entre Ciência Política e Direito, adotando-se como marco teórico a Legística.
